What is Florida’s responsible vendor program?

The Florida Responsible Vendor act aims to prohibit the sale and consumption of alcoholic beverages by individuals who are underage. It also aims to reduce accidents and injuries caused by alcohol intoxication. In addition, the act encourages vendors and their employees to prevent drug activity on their premises, and to be cautious in their serving practices. Vendors who comply with responsible practices are rewarded with less severe sanctions in administrative proceedings. The act promotes responsible policies for serving and promoting alcoholic beverages, to prevent over-serving and over-consumption. It also encourages professionalism and responsibility on the part of vendors who sell or serve alcoholic beverages.

To qualify as a responsible vendor, the vendor must comply with the following rules:

  • Provide comprehensive training for all servers and sellers of alcoholic beverages is crucial to ensure that they possess the requisite knowledge and expertise to handle such products responsibly and safely. The training must specifically cover topics related to alcoholic beverages and, where applicable, controlled substances. Similarly, managers must undergo specialized training that covers relevant content areas to enhance their capacity to manage related risks.
  • All new employees who are not managers must complete the required training within 30 days of their hire date. Until they receive the necessary training, such employees must always be supervised. On the other hand, new managers are expected to complete the required manager training within 15 days of their hire date.
  • To ensure adherence to established policies, all employees are required to participate in informational meetings every four months. These meetings will cover the licensee’s policies and topics related to the sale and service of alcoholic beverages. Additionally, all employees must complete a form that will help to determine whether they are prohibited under the law from selling or serving alcohol. This form must be filled out as a condition of their employment.
  • To reinforce the importance of maintaining a safe and controlled environment, a house policy must be established that unequivocally states that any employee who unlawfully uses a controlled substance on the licensed premises will be immediately terminated. This policy must be in writing and acknowledged in writing by all employees.
  • Finally, all written records must be maintained, including applications, training records, acknowledgments, and any other records that document the licensee’s enforcement of policies that require dismissal from employment. Warning signs must be posted in visible locations to customers, stating that the licensee’s policy is not to serve minors. The consequences of non-compliance must be included in the warning sign. Similarly, warning signs must be posted stating that the use and/or sale of controlled substances is prohibited on the licensed premises, and the consequences of non-compliance must be clearly documented.

The Florida Department of Business and Profession Regulation has created a Responsible Vendor Qualifications Checklist to assess what licensed vendors need to meet the required qualifications. The Florida statutes that pertain to Florida Responsible Vendor Training are Sections 561.701, 561.702, 561.703, 561.705, and 561.706. The State of Florida created this program to promote responsible and safe practices among alcohol-serving establishments and their staff.
